To record the outcomes of applications for intervention orders under the Family Violence Act in the Victorian Magistrates’ and Children’s Courts, as a basis for analysis of court workloads, outcomes of applications for policy and legislation development purposes and as the basis of publications for the community. DESCRIPTION The Courtlink database is the official register of the Magistrates’ and Children’s Courts of Victoria. An intervention order is a court order made under the Family Violence Protection Act 2008 where there is a family relationship or a person is or has been involved in a relationship. DEFINITION OF FAMILY AND DOMESTIC VIOLENCE The Family Violence Protection Act (2008), defines family violence, including for the purposes of Intervention Order applications as:
Data prior to 2008 reflect the definition in the Crimes (Family Violence) Act 1987, section 4, which provides that a court may make an intervention order against a person, if on the balance of probabilities, the defendant had assaulted a family member or damaged their property, and was likely to do so again; threatened to assault a family member or damage their property and was likely to do so again; and/or harassed or molested a family member or behaved in an offensive manner toward them, and was likely to do so again. A family member for the purpose of Family Violence Intervention applications includes any person whom the affected family member regards or regarded as being ‘like’ a family member. For example, this may include carers of persons with a disability. Aspects of family and domestic violence captured by the data are:

Person; 3. Incident/Event; and 4. Transaction. Tables are absent from the entry in cases where the data source contains no data items which relate to the particular counting unit/s. Data is entered into Courtlink by administrative staff at each court location in Victoria. SCOPE / TARGET POPULATION People/children who apply for an intervention order under the Family Violence Act through the Magistrates’ Court/Children’s Court. COVERAGE n/a DATA AVAILABILITY / DISSEMINATION Data relating to the number of family violence intervention order applications issued, orders finalised, changes over time and expenditure on Family Violence programs are published in Magistrate’s Court Annual reports. Courtlink data are also provided to the Victorian Family Violence Database. Additional Family Violence Intervention data, held in data cubes, as part of the larger Lower Courts Database may be provided free upon request. Data are available from 2001. Courtlink is not accessible to the general public and all information released from this database through other media or software, such as data cubes, have confidential information removed.
